1. Introduction and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Zen Tech LLC ("Zen Tech," "we," "us," or "our") governing your access to and use of our mobile application "Believer", our websites, and related services (collectively, the "Services").

By downloading, installing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

IMPORTANT NOTICE FOR U.S. USERS: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 16) THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY.

2. Eligibility

You must be at least 13 years of age to use our Services. If you are under 18 (or the age of legal majority in your jurisdiction), you may only use our Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. License Grant and Restrictions

3.1 License Grant Subject to these Terms, Zen Tech LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.

3.2 Prohibited Conduct You agree NOT to:

Use the Services for any illegal purpose or in violation of any local, state, national, or international law.
Copy, modify, decompile, reverse-engineer, or attempt to derive the source code of the Services.
Remove any copyright or proprietary notices.
Use any robot, spider, or automated means to access the Services.
Harass, threaten, demean, or embarrass other users.
Transmit viruses, malware, or other malicious code.

4. Account Registration

To access certain features, you may be required to register an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We reserve the right to disable any account at any time if, in our opinion, you have failed to comply with any provision of these Terms.

5. User Content and Conduct

5.1 User Content The Services may allow you to post, store, or share content (text, images, video) ("User Content"). You retain ownership of your User Content. However, by posting it, you grant Zen Tech LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, and display your User Content to operate and improve the Services.

5.2 Content Standards (Zero Tolerance Policy) We have a zero-tolerance policy for objectionable content. You are strictly prohibited from posting content that:

Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful.
Promotes discrimination based on race, ethnicity, religion, disability, gender, age, or sexual orientation.
Displays sexual acts or pornography.
Bullying or harassment of other users.

5.3 Moderation and Enforcement We reserve the right to monitor User Content and to remove any content that violates these Terms. We may also suspend or terminate the accounts of users who violate these standards without prior notice.

6. DMCA Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person or entity.

If you are a copyright owner and believe your work has been copied in a way that constitutes infringement, please submit your claim via email to support@zentecapps.com, with the subject line: "Copyright Infringement" and include:

A physical or electronic signature of the copyright owner.
A description of the copyrighted work claimed to have been infringed.
A description of where the material is located on the Service.

7. Intellectual Property Rights

The Services and their original content (excluding User Content), features, and functionality are and will remain the exclusive property of Zen Tech LLC and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries.

8. Third-Party Links and Services

Our Services may contain links to third-party web sites or services that are not owned or controlled by Zen Tech LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

9. Updates and Maintenance

We may from time to time provide enhancements or improvements to the features/functionality of the Services, which may include patches, bug fixes, updates, upgrades, and other modifications ("Updates"). You agree that we have no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities.

10. Subscriptions and Payments

10.1 In-App Purchases If you purchase an auto-renewing subscription through the App, your Apple ID or Google Play account will be billed continuously for the subscription until you cancel.

10.2 Renewal and Cancellation

Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
Billing: Your account will be charged for renewal within 24-hours prior to the end of the current period at the cost of the chosen package.
Cancellation: You can manage and cancel subscriptions by going to your Account Settings on the App Store or Google Play Store after purchase.
No Refunds: We do not offer refunds for any unused portion of a subscription period. All refund requests must be directed to Apple or Google directly, as they manage the banking transaction.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ZEN TECH LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZEN TECH LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

13. Indemnification

You agree to defend, indemnify, and hold harmless Zen Tech LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from your use of the Services or your breach of these Terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Dispute Resolution (Arbitration)

15.1 Binding Arbitration Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Delaware before one arbitrator.

15.2 Class Action Waiver YOU AND ZEN TECH LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. App Store Specific Terms (Apple Users)

If you access our Services via an application obtained from the Apple App Store, the following applies:

Acknowledgment: These Terms are between you and Zen Tech LLC only, not Apple, and Zen Tech LLC is solely responsible for the App and the content thereof.
Maintenance: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
Product Claims: Zen Tech LLC, not Apple, is responsible for addressing any claims of you or any third party relating to the App, including product liability claims and claims arising under consumer protection laws.
IP Rights: In the event of any third-party claim that the App infringes that third party’s intellectual property rights, Zen Tech LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
